
On Friday, November 1, 2024, a video went viral on social media showing two men with their wheelbarrows loaded with products being guided by an individual to a toll booth in Ixtapa. One of the men was transporting CempasĂșchil flowers, while the other carried various items.
In the images, it can be observed how the person who apparently worked at the Tenango-Ixtapa toll booth leads one of the men to the payment window to pay the corresponding toll for his wheelbarrow. The other man simply hands his money to the individual working at the booth, who takes care of making the payment on his behalf.
After paying the toll, the woman in charge of the booth allows the two men to pass with their products. It is worth noting that since this is a toll on a highway designed for vehicles, there is controversy over whether it is legal to charge tolls to people walking with sales wheelbarrows.
In this context, it is important to remember that Article 11 of the Political Constitution of Mexico establishes the right to free movement of people within the national territory. However, this right can be restricted for reasons of security, health, or to protect the rights of third parties, according to the law. In cases of violations of this right, individuals can assert their rights before the competent authorities.
While CAPUFE (Federal Roads and Bridges) manages the toll roads, it is necessary to consult the specific regulations of each toll booth to determine whether sales wheelbarrows are subject to toll payment. Despite this, the situation raises questions about the interpretation and application of the regulations in such specific cases.
